Terms of Use for Messages – SMS & MMS

Welcome to Messages – SMS & MMS. These Terms of Use ("Terms") govern your access to and use of the Messages – SMS & MMS mobile application (the "Service") provided by ADUPLIFT LLP ("we," "us," or "our").
By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.
1. Description of Service
Messages – SMS & MMS is a mobile application designed to act as the default SMS and MMS handler on your Android device. It allows you to send, receive, view, and manage text messages and multimedia messages.
Default Handler Requirement: To utilize the Service, you must explicitly grant the application permission to act as your device's default SMS handler.
Carrier Charges: The Service utilizes your mobile carrier's network to send and receive SMS and MMS messages. You acknowledge and agree that standard messaging rates, data charges, and other fees from your mobile carrier may apply. ADUPLIFT LLP is not responsible for any charges incurred through your use of the Service.
2. User Responsibilities and Conduct
By using the Service, you agree that you are solely responsible for the content of the messages you send and the consequences of sharing them. You agree NOT to use the Service to:
Send illegal, abusive, harassing, threatening, or defamatory content.
Distribute spam, unsolicited promotions, or unauthorized commercial communications.
Share malicious software, viruses, or any code designed to disrupt or damage devices or networks.
Violate the privacy or intellectual property rights of others.
3. Data Storage and Risk of Loss
Local Storage: The Service processes and stores your messages and media locally on your device using native Android database structures.
No Cloud Backup: We do not provide cloud backup services or store your messages on our servers. You are solely responsible for securing your device and creating independent backups of your data if desired.
Data Loss: ADUPLIFT LLP shall not be liable for any loss, deletion, or corruption of your messages, contacts, or media under any circumstances, including device failure, app uninstallation, or app malfunction.
4. Third-Party Services and Integrations
The Service incorporates third-party plugins, libraries, and software development kits (SDKs) to provide specific functionalities and support the operation of the app. By using the app, you acknowledge and agree to the involvement of these services:
Google AdMob: The Service is ad-supported and uses Google AdMob to display advertisements.
Google Play Services (Location & Maps): The Service utilizes these APIs to allow you to attach and share your location in messages. Your use of this specific feature is subject to the Google Maps/Google Earth Additional Terms of Service.
Firebase (Analytics, Crashlytics, Performance, Messaging): We use Firebase SDKs to monitor app stability, analyze usage trends, and deliver necessary backend data to keep the app running smoothly.
We do not control these third-party services, and your interaction with them is governed by their respective Terms of Service and Privacy Policies.
5. Intellectual Property Rights
All rights, title, and interest in and to the Service (excluding your personal messages and third-party software/libraries) are and will remain the exclusive property of ADUPLIFT LLP. The app's design, code, graphics, and interface are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit written permission.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. ADUPLIFT LLP MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO:
The uninterrupted availability or reliability of the Service.
The successful delivery or receipt of any SMS or MMS messages (which is dependent on mobile networks).
The accuracy or safety of any third-party links or location data shared within the app.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ADUPLIFT LLP BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; OR (B) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.
8. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. We will notify you of any changes by updating the "Effective Date" at the top of these Terms. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
